Metro Shops Merchant Use Agreement
Merchant user agreement with MetroShops.com or otherwise referred to in this document as Metro Shops.
- All merchants will maintain a business information page detailing order and shipping information and provide an email address for customer contact.
- Merchants will not sell anything deemed inappropriate and agree to immediately remove any items Metro Shops deems to be inappropriate or unacceptable. Merchants will not offer any items pornographic, that promote hate, racial or religious bias.
- Merchants will ship all orders within 30 days of order receipt or otherwise properly notify all concerned parties of shipment delay or inability to ship.
- All closeout items must be in stock and immediately available for shipping. Upon inventory depletion, items must be removed from visible offering.
- Indemnify and hold harmless Metro Shops from any claims resulting from the use of the service that damages the subscriber or any other party.
- Identical Items offered on merchant's main website or satellite website(s), will NOT be priced higher on Metro Shops website.
- Merchant will ship clearly identify all shipping charges and will not include add charges above the actual estimated shipping charge.
- Order returns and cancellations will be handled based on your established guidelines. You must maintain a policy of returns or cancellation policies on your business info page on Metro Shops.
- You will not collect email address from Metro Shops orders to be used for the purpose of spam or unsolicited email. You will not sell or distribute sensitive customer information, including email address.
- Agree that the information regarding all products is accurate and that you will not substitute an item for items being displayed for sale.
- You operate a legitimate business and will provide documentation. You can provide an; Employer Identification Number (EIN); State or local business license; Corporate or DBA papers; a utility or phone bill.
- Merchants are limited to offering 500 items for sale through Metro Shops at any one time.
- Merchants must immediately remove from their offerings any item that is no longer available.
- Merchant store may be made inactive if Metro Shops receives a complaint that Metro Shops determines is legitimate from a customer regarding the merchant. A merchant may be removed from our system if Metro Shops receives 3 or more complaints. In that even, the merchant will not be entitled to any monetary refunds or fees of any kind.
- Merchants agree to be rated by customers and to have those ratings posted at our web site.
- Must accept credit card payments of Master Card, Visa, AMEX or Discover though their current business, or, it is suggested that merchants set up payment acceptance through PayPal integration.
- Users may not use systems or techniques to circumvent, or avoid fees.
- Keyword spamming occurs when merchants place brand names or other inappropriate keywords in a title or description for the purpose of gaining attention or diverting shoppers to a listing. Keyword spamming in listings is not permitted and all text that sellers place in listings must be directly relevant to the item being sold.
- Sellers are not permitted to create titles for their listings that do not accurately describe the item for sale.
- Identical items may not be offered at a lower price on a stores primary web site.
- Items can be entered individually through a simple form. It is your responsibility to provide accurate information.
- It is the sellers responsibility to retrieve their own individual orders. Metro Shops sends an order notification email, however we suggest that your account is checked on a regular schedule. Orders are initially marked "open." When retrieved the merchant must mark the order as "processed."
- After retreiving the order it is the merchants responsibility to inform the consumer that their order has been accepted by you. It is a good idea to advise the consumer at that time when they should expect to receive their order.
- Metro Shops reserves the right to limit the number of merchants it accepts by type of merchant.
- Metro Shops reserves the right to refuse any merchant.
- Metro Shops may wish to limit products offered by a merchant by; product count, product category, product price, type of product or service offered.
- Metro Shops manages the products displayed on the web site carefully. Only a single category listing is allowed for a product. Metro Shops may change a product's category or deactivate a product without notice. A merchant may email Metro Shops to request a duplicate listing of a product in a second category.
- The seller agrees to keep a valid credit card securely on file with Metro Shops, to pay for fees specified on the Metro Shops Fees page.
